Surrogate Country System, or so-called Analogue Country, System, refers to the fact that, when determining normal value of goods exporting from non-market economies, the actual costs of goods in the exporting countries are not considered, but choose prices of like products from a market economy or other third importing country to calculate the normal value. The market economy or the third importing country is often called “Surrogate Country”.

The developed countries often hold such an opinion, in non-market economy countries; the product price is subject to the government. Furthermore, foreign exchanges of non-market economy countries and currencies of the developed countries are not freely convertible to each other, thus making the domestic price and the price in the foreign market lack of direct contact and incomparable with each http://www.ukassignment.org/yingguolunwen/other. Therefore, in this situation, normal value of the like product shall be determined not on the basis of the domestic price in non-market economy countries but on the basis of the domestic price or constructed price in an appropriate third country with market economy, or on the basis of the export price from such a third country to other countries, or, where those are not possible, on the basis of the price actually paid by the developed countries plus reasonable profits.

China is recognized as a non-market economy all the time, thus, in anti-dumping investigation, the normal value of exporting products of China is subject to price of like product of other surrogate countries. Sometimes the system is too strict to be fair, that’s why Chinese products are often considered as dumped products. In 1999, China accessed to the WTO, finally integrating all anti-dumping investigations against China into the framework of the WTO anti-dumping regulation system. However, Article 15 of Protocol of China joined the WTO  had regulated that, in the 15 years after joining WTO, if China cannot be confirmed as a market economy according to the domestic law of member countries, the importing countries could still adopt special method of price comparability against Chinese exporting products.
